How much regulatory time should a higher-risk building programme carry?
Plan for the Gateway 2 determination, five working days notice before starting, then at Gateway 3 an eight week determination from a valid application plus a final inspection and registration. On recent published medians that is roughly five to six months of regulatory time across the project, before any rejection or change control stoppage.
Should I plan against the statutory clock or the real one?
The real one. The statutory determination is 12 weeks for new builds and 8 weeks for work to existing higher-risk buildings, while BSR's latest new-build and conversion data reported a 22-week median. Planning only against the statutory minimum leaves no allowance for current performance.
Why is there a gap between finishing and occupation?
Because practical completion no longer permits occupation on a higher-risk building. The Gateway 3 certificate and registration both have to be in place first, and who carries the cost of that gap is now a live contract negotiation.
